With the commencement of the second phase of the Energy Savings Opportunity Scheme (ESOS), the Environment Agency has revealed that it has already issued more than 300 enforcement notices to non-compliant organisations, with more set to be issued this financial year. It requires businesses to audit their energy use and covers all large businesses in the UK with at least 250 employees, or with an annual turnover above £38.9 million and an annual balance sheet total above £33.4 million.

The Environment Agency has urged companies to begin carrying out energy audits ahead of the compliance deadline of the second phase of ESOS on 5th December 2019. Non-complying organisations will face severe fines, reaching as high as £90,000 for the most serious infractions. Companies cannot yet carry out the assessment of their ‘total energy consumption’, as this must include the qualification date of 31st December 2018. However, businesses can start to audit supplies which they know will constitute ‘significant energy consumption’.
